Terms and conditions of sale

The TOF PARIS SAS company (hereinafter referred to as THE SELLER) is listed on the Paris trade register under number 809 996 374 RCS PARIS.

Any order on the www.tof-paris.com website implies the consultation and prior acceptance of these terms and conditions of sale. Confirmation of the order implies acceptance of these conditions and a digital signature.

The Customer declares that they are a natural person, aged over 18. They have full legal capacity or parental authorization allowing them to purchase online. The Customer must ensure the accuracy and completeness of mandatory data when registering in the “my account” section.

1 PURPOSE AND WARRANTY

These general terms and conditions are intended to define the rights and obligations of the parties within the framework of online sales of goods proposed by the TOF PARIS SAS company to consumers. Minor errors may exist on the website.

2 ORDER CONFIRMATION

The contractual information shall be confirmed by email to the address indicated by the consumer on the order form.

3 PROOF OF THE TRANSACTION

The digital records, stored in the computer systems of the TOF PARIS SAS company under reasonable security conditions, shall be considered proof of correspondence, orders and payments between the parties.. Purchase orders and invoices are archived on reliable and durable media that can be produced as evidence.

4 PRODUCT INFORMATION

Every effort has been made to ensure the accuracy of information presented on the website. The TOF PARIS SAS company or its suppliers are however not responsible for the consequences arising from electronic transmission or the accuracy of the information transmitted. The names of products are only used for the purpose of identification. Photographs, descriptions and product prices are not contractual.

5 PRICE AND PAYMENT TERMS

When prices are in euros, they include French taxes and exclude shipping costs. When prices are quoted in ANY another currency, they exclude all taxes and shipping costs.

Promotions are valid for the period indicated on the website, on condition of acceptance of the order and your payment by TOF PARIS SAS and while stocks last.

The following payment methods are accepted: Visa, Eurocard, Mastercard, e-Carte Bleue, wire, Paypal and Stripe.

6 TERMS OF DELIVERY

Products shall be delivered to the address indicated by the consumer on the purchase order and only in the geographic areas delivered.

Products leave our premises in perfect condition.

We may not be held liable for the lengthening of delivery times caused by the carrier, especially in the case of loss of products, exceptional circumstances, bad weather or strikes.

7 DELIVERY PROBLEMS CAUSED BY THE CARRIER

Any problems regarding delivery (damage, missing product compared to the delivery form, damaged package, broken products, etc.) must be indicated on the delivery form as “handwritten reservations”, together with the customer’s signature

The consumer must inform TOF PARIS SAS of these problems, by any means at their convenience and within 5 working days after delivery. Once we have observed any problems, we can exchange the product.

8 DELIVERY ERRORS

The consumer must lodge a complaint regarding a delivery error and / or non-compliance of products on the day of the delivery or at the latest on the first working day following delivery, with TOF PARIS SAS, by any means at their convenience and within 5 working days.

Beyond this period, any claim shall be rejected and shall release the TOF PARIS SAS company from any liability with respect to the customer.

In case of a delivery or exchange error, any product to be exchanged or refunded must be returned to the TOF PARIS SAS company in full and in its original packaging in perfect condition at the address of the TOF PARIS SAS company.

9 EXCHANGES AND RETURNS

The right of withdrawal only applies to natural persons. The consumer has a deadline of fifteen (15) calendar days to return any unsuitable products at their expense. This period starts from the day of receipt of the order by the consumer.

Any return may be notified beforehand to the TOF PARIS SAS customer service department.

Only undamaged, unused products returned in their original packing in perfect condition for resale shall be accepted. Any product that has been damaged or whose original packaging has been damaged, shall not be refunded, returned or exchanged. Products bought in the sales shall not be taken back.

The right of withdrawal may be exercised without penalty. Return shipping costs however are the responsibility of the consumer.

When a consumer exercises their right to withdraw their order, they have the option to either request a refund of the money paid, or to exchange the product.

10 RIGHTS OF USE

The reproduction or representation, whether full or partial, of pages, data or any other element of this website by any means or on any medium whatsoever is prohibited and without permission of the owner of the rights, constitutes a forgery.

11 FORCE MAJEURE

Neither party shall have breached its contractual obligations, insofar as their fulfillment is delayed, hindered or prevented by an uncontrollable event or force majeure. Force majeure shall be understood to mean any compelling fact or circumstance exterior to the parties, that is unpredictable, inevitable, independent of the will of the parties and which cannot be prevented by them, despite all reasonable possible efforts.

The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware.

Both parties shall then contact each other, within three months, unless that is impossible due to force majeure, to examine the impact of the event and agree the conditions under which the contract shall be continued. If the force majeure lasts more than one month, these terms may be terminated by the injured party.

The following events are expressly considered as cases of force majeure or fortuitous events, besides those usually accepted by French case law and the courts: blocking of means of transport, earthquake, fire, storm, flooding, lightning, stoppage of telecommunications networks or difficulties specific to customers’ external telecommunications networks.

12 PARTIAL NON-VALIDATION

If one or more provisions of these terms are held to be invalid or declared as such under any law, regulation or following a final decision of a competent court, the other provisions shall remain in full force and effect.

13 NON-WAIVER

The failure of either party not to claim a breach by the other party of any of the obligations under the framework of these terms and conditions cannot be construed in the future as a claim to the obligation in question.

14 GOVERNING LAW

These terms and conditions are subject to French law. Any disputes must be declared to our customer service department: contact@tof-paris.com. The settlement of disputes resulting from the interpretation, application performance or non-performance, the termination of the General Terms and Conditions shall fall under the exclusive jurisdiction of the French courts.

15 DISPUTES

The placing of any order through the www.tof-paris.com website incurs the customer’s unrestricted acceptance of the general terms and conditions of sale of the TOF PARIS SAS company.
